Terms of Use

These Terms of Use ("Terms") are a contract between you and ListenPrep ("ListenPrep", "we", "us") governing your use of the ListenPrep website, mobile app, and related services (together, the "Service"). Please read them carefully.
1. Acceptance of these Terms
By creating an account, using the Service as a guest, or otherwise accessing the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old to use the Service. ListenPrep is intended for physician assistant (PA) students and candidates preparing for the PANCE and similar exams. By using the Service you represent that you meet this age requirement.
3. Accounts and guest use
You can use much of the Service as a guest, without creating an account; in that case your progress is stored on your device and may be lost if you uninstall the app or switch devices. Creating an account lets you sync progress across devices. You're responsible for keeping your account credentials secure and for all activity under your account. Tell us right away if you suspect unauthorized use.
4. License to use the Service
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own exam preparation. You may not sublicense, sell, rent, or otherwise transfer this license to anyone else. We may suspend or revoke this license if you violate these Terms.
5. Subscriptions and auto-renewal
Some features require a paid subscription, billed and processed through the Apple App Store or Google Play, depending on where you downloaded the app. Subscriptions automatically renew for the same term unless you cancel at least 24 hours before the end of the current period. You manage or cancel your subscription in your Apple ID or Google Play account settings, not through us directly — we do not have access to cancel it on your behalf. If we offer a free trial, it automatically converts into a paid subscription at the end of the trial unless you cancel before the trial ends.
6. Exam Passes (one-time purchases)
We may also offer one-time "Exam Passes" that are not subscriptions: they do not renew, and they grant access to specified content or features for a fixed length of time from purchase, as described at the time of purchase. Once that period ends, access ends unless you purchase again.
7. Refunds
All purchases are billed by Apple or Google, and refunds are handled under their respective refund policies, not ours. To request a refund, contact Apple or Google support directly through your purchase history in the App Store or Google Play.
8. Educational use only — not medical advice
ListenPrep is a study aid for exam preparation. It is not medical advice, and nothing in the Service is a substitute for the clinical training, supervision, or professional judgment you receive in your PA program or clinical practice. We do not guarantee any particular exam score, pass rate, or outcome, and you should not rely on the Service as your sole source of exam preparation.
9. Not affiliated with NCCPA
ListenPrep is not affiliated with, endorsed by, or sponsored by the National Commission on Certification of Physician Assistants (NCCPA). PANCE® is a registered trademark of NCCPA, used here only to describe the exam our content helps you prepare for.
10. Acceptable use
You agree not to: use the Service for any unlawful purpose; attempt to reverse-engineer, scrape, or extract the underlying content or code; share your account or paid access with people who haven't purchased it; interfere with or disrupt the Service's operation; or upload or submit content that is unlawful, infringing, or abusive.
11. Our content and intellectual property
The Service, including its audio episodes, questions, explanations, artwork, mascots, and software, is owned by ListenPrep or its licensors and is protected by copyright and other intellectual property laws. Your license under Section 4 does not transfer any ownership to you.
Music credits. Some songs featured in the Service are generated using YuE-2 and are licensed under Creative Commons Attribution-NonCommercial 4.0 International (CC BY-NC 4.0). Attribution for these tracks is shown in the app alongside the content.
12. Your feedback
If you report a problem with a question or submit other feedback through the app (for example, a "report this question" flag), you grant us a perpetual, worldwide, royalty-free license to use that feedback to improve the Service, without any obligation to compensate or credit you.
13. Termination and account deletion
You may stop using the Service at any time. You can delete your account and associated data in the app under Settings → Delete account, or through our account deletion page. We may suspend or terminate your access if you violate these Terms. Deleting your account does not automatically cancel an active subscription — cancel that separately in your Apple ID or Google Play account settings.
14. Disclaimers and limitation of liability
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, ListenPrep will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or exam outcomes, arising from your use of the Service.

16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll notify you in the app or by email, and continued use of the Service after the change takes effect means you accept the updated Terms.
